Pincushion Privacy Policy

Higher Function, Inc. maintains and operates the Pincushion software and service. The Pincushion Web site (located at http://www.mypincushion.com/), and any additional Web sites owned or operated by Higher Function are individually and collectively referred to herein as the "Site". The Pincushion software (available for download from http://www.mypincushion.com/install/) is referred to herein as the "Software".

Ways You Use Pincushion

Individuals accessing the Site or utilizing the Software who do not possess a Pincushion account, or who are not "Logged In" to the Site or Software and have deleted any login cookies associated with the Site, are referred to herein as "Anonymous Users".

Individuals running the Software on their computers who are "Logged In", and individuals accessing the Site by clicking on an Invitation Email or entering their username and password into the Site to log in, are referred to herein as "Authenticated Users".

Information We Collect

Non-Personally Identifiable Information

As a general policy, we do not automatically collect any personally identifiable information from Anonymous Users accessing the Site or utilizing the Software. Aggregate statistical information may be compiled from your use, in combination with other Anonymous Users, of the Site and/or Software. This non-personally identifiable information may be linked to general demographic information about the users of the Site and Software. In the course of accessing the Site, you may disclose to us standard information such as your computer’s IP address, ISP, operating system, browser software, page views, click streams, etc. If you use the Software, you will additionally disclose information on other Web sites that you visit while the Software is enabled. Such disclosure is technically necessary for the normal operation of the Software—without said disclosure, the Software and service will not function properly.

Personally Identifiable Information

Many of the features of the Site and the Software require specific information about you. In the course of using the Site and Software, you may be asked to provide your email address, name, physical address, birth date, and other information. Certain value-added services may require you to enter financial information such as a credit / debit card number and billing information.

The Pincushion Interest Engine is an automated software system capable of recommending items of interest to you based on analysis of your history. This system is completely private and does not reveal any personally identifiable information about you to any third party. If you opt for Pincushion to show you recommendations, these recommendations will be selected by the Interest Engine software.

If you access the Site or Software as an Authenticated User, non-personally identifiable information may be linked to your personally identifiable information. In such cases, all linked information will be treated as personally-identifiable information.

How We Use Information

Our privacy policy only governs information collected on the Site.

Public Content

The Site and Software provide Users and Third Parties with the ability to post content and to respond to content. Please be aware that whenever you post publicly visible content, that content is visible to any User or Third Party utilizing the Site or the Software. The Site and the Software have been designed to provide a high degree of privacy and protection from unsolicited communications and unintended eavesdropping, but no system is perfect. Higher Function is not responsible for the personally identifiable information you elect to make available or make available through omission of filtering and control preferences. We strongly urge you to customize your privacy preferences before posting, or replying to, comments by logging in to the Site and visiting the Pincushion Privacy Web page (http://www.mypincushion.com/My/Privacy.aspx).

Choice / Opt Out

All email delivered to you by the Pincushion Service is sent at the request of an existing Pincushion User. The User requesting an email be sent to you is always identified by their chosen Display Name and a verified email address. As a Pincushion User, you may choose not to receive certain types of notifications by email. These options are accessed by logging in to the Site and visiting the Pincushion Privacy Web page (http://www.mypincushion.com/My/Privacy.aspx). You may also elect to receive no email or other communications from Higher Function, Inc. by sending an email to privacy@higherfunction.com with only the words "opt out" in the subject line. Please note that ONLY the sending email address will be tracked by such a request.

Transfer of Assets

As we continue to develop our business, we may sell or purchase assets. If another entity acquires us or all or substantially all of our assets, personally identifiable information, non-personally identifiable information, and any other information that we have collected about the users of the Site will be transferred to such entity as one of the transferred assets. Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

Privacy of Children

This Site is not directed to children under the age of 13. Higher Function does not permit registration by, and will not knowingly collect or use personally identifiable information from, anyone less than 13 years of age, except for the limited circumstances described below. In the event a child under the age of 13 submits a question to us on the Site and identifies his or her age, we may use the child's email address for the sole purpose of responding to the child's question on a one-time-only basis. We will not use the child's email address to re-contact the child and we will delete it from our records once we have responded. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.

Security

The Site takes reasonable and appropriate measures to protect private information that is stored on the Site or on our servers against unauthorized access and disclosure, and we restrict access to such private information to those employees who need access to perform their job functions, such as our customer service personnel and technical staff. Please be advised, however, that while we strive to protect your personally identifiable information and privacy, we cannot guarantee the security of any information you disclose or transmit to us online and cannot be responsible for the theft, destruction or inadvertent disclosure of your personally identifiable information. For any additional information about our security measures this Site uses on our Website, please contact us with specific questions at privacy@higherfunction.com. If you create an account on the Site, you may be asked to choose a password for your account, in which case, access to your account shall be protected by your password. We recommend that you do not disclose your password to any other person, that you use a combination of letters and numbers for your password, and that you change your password often. You are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account. You may view and update your account information at any time by logging into your account.
